Sanibel Island, Florida 33957

Dear Judie Zimomra:

The Sanibel & Captiva Islands Association of REALTORS® has been diligently attempting to write an "Emergency Disaster Build Back Ordinance" ("Ordinance") since October 2003, with the assistance of David Depew, a City Planner, and Bob Pritt, past Sanibel City Attorney. Our goal is to provide a usable working draft of an "Ordinance" that will allow the build back of nonconforming properties.

This effort proved to be a very difficult, complicated and time consuming issue to address. Our committee listened very carefully, over many months, to many different Island organizations' and individual citizens' points of view and concerns on this subject. We tried very hard to incorporate all of these concerns and issues into the enclosed "Emergency Disaster Build Back Ordinance".

We have prepared a document that we believe is fair to all, and could be passed as written. It deals only with the "Emergency Build Back" issue. It does not in any way address redevelopment. We have taken great care in preparing this document and believe we have addressed the burning issues concerning this subject.

The Sanibel & Captiva Islands Association of REALTORS® in submitting this proposal, would like the City Council, the Planning Commission and staff to study this document carefully and encourage public input and debate as soon as possible. We respectfully request the ability to be involved in this project through completion and passage of this ordinance. Hurricane season is upon us and it would give everyone some piece of mind knowing that this "Ordinance" is in process and would be n place as soon as possible. Should you have any questions concerning any part of the Ordinance proposal, please feel free to contact me anytime.

Very truly,

David L Schuldenfrei CRS,GRI
2004 President
Sanibel & Captiva Islands Association of REALTORS®.
